Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Its AI? iOS application (the "App") operated by Mobinuity ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.
1. What the App does
The App analyzes media you provide (photos, short videos, audio clips, and text) and returns a probabilistic assessment of whether that content was likely generated by an artificial intelligence model.
2. Detection is probabilistic — not proof
AI-detection technology is imperfect. Modern generative models routinely produce output that is difficult or impossible to reliably distinguish from human-created content, and perfectly human-created content sometimes produces false positives. You agree that:
- Verdicts are estimates, not legal or forensic conclusions.
- You will not use the App as the sole basis for making accusations, legal claims, employment decisions, academic misconduct claims, journalism, or any consequential judgment about a person.
- We make no warranty, express or implied, regarding the accuracy of any verdict produced by the App.
3. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code or model prompts from the App.
- Submit content you don't have the right to share, including media of third parties submitted without their consent where consent is legally required.
- Use the App to harass, defame, or harm another person.
- Use the App to generate high-volume or automated requests designed to burden our infrastructure.
- Circumvent fair-use rate limits, App Check enforcement, or subscription gating.
4. Subscriptions and billing
4.1 Plans
The App offers two subscription tiers, Essential and Pro, each available as weekly, monthly, yearly, or lifetime purchases. Prices are displayed in the App at purchase time and in your local currency when possible.
4.2 Auto-renewal
Recurring subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the current period ends. Payment is charged to your Apple ID at confirmation of purchase and at each renewal. You can manage or cancel subscriptions in your iOS Settings > [Your Apple ID] > Subscriptions.
4.3 Free trial
If a free trial is offered, the full subscription price is charged at the end of the trial unless you cancel at least 24 hours before the trial ends. Deleting the App does not cancel the subscription.
4.4 Refunds
All refund requests are handled by Apple through the App Store. We cannot issue refunds directly. Apple's refund policy is available at support.apple.com.
4.5 Lifetime purchases
"Lifetime" means the lifetime of the App — that is, for as long as the App remains available and operated by Mobinuity. It does not mean perpetual access independent of the product.
5. Intellectual property
The App, its design, its code, and all associated trademarks are the property of Mobinuity. You retain all rights to the content you submit for analysis — we do not claim any ownership over your media. The verdict strings produced by the App may be reproduced by you freely.
6. Service availability
We aim for reliable uptime but do not guarantee that the App will always be available, uninterrupted, or free of errors. We may update, change, or suspend features at any time, including during a paid subscription, where reasonably necessary. Material changes affecting your subscription tier will be communicated with reasonable notice.
7. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, Mobinuity will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from your use of or inability to use the App. Our total liability for any claim arising from the App will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD 50.
9. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by deleting it from your device; subscription cancellation is handled separately as described in Section 4.
10. Governing law
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules. Disputes will be resolved in the courts of [JURISDICTION], except where mandatory consumer-protection rules of your country of residence provide otherwise.
11. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above and, where the changes are material, we'll give you reasonable notice in the App. Continued use after the changes take effect means you accept the revised Terms.
